TERMS & CONDITIONS

1. Background

1.1. “The Best Semester Abroad” Competition (“Competition”) is conducted by the State of Queensland through Trade and Investment Queensland ABN 93 887 376 875 (“the State”).

1.2. Information on how to enter and the prizes form part of these Terms and Conditions of Entry (“Terms and Conditions”).

1.3. By submitting a completed “The Best Semester Abroad” official entry form, the “Entrants” accepts the Terms and Conditions.

1.4. The Competition commences at 12:01am (Australian Eastern Standard time (“AEST”) on Friday 29 April 2016. in all Participating Countries (other than Mexico, where the Competition shall commence at 12:01am AEST on Friday, 6 May 2016). Entries close at 11.59pm (AEST) on Sunday 26 June 2016 (“Closing Date”). Entrants will need to determine the local start and close dates and times based on the time zone in their location.

2. The Prizes

2.1. Entry into the competition gives Entrants that comply with the eligibility criteria set out in clause 4 the chance to win the following prizes:
(a) One prize package to two Entrants from each participating country set out in clause 7.3 (“Participating Country”) (“Winners”).
(b) One Partial University Scholarship to five Winners (“Ultimate Winners”).

2.2. The prizes are summarized below and provided in detail in Schedule A:

Ultimate Winners
• Partial university scholarship as set out in Schedule A (“Partial Scholarship”)

The maximum value of the prizes associated with the competition is $750,000; being $600,000 in Winner’s prizes (for up to 20 Winners) and $150,000 in Ultimate Winner’s prizes (for up to 5 Ultimate Winners).

3. Conditions on the Prizes

3.1. Conditions for the Winners and the Ultimate Winners
(a) All land arrangements and flight bookings are subjected to availability. The State reserves the right to revise any element of the prizes, including how many prizes are provided or how many prizes are provided per Participating Country.
(b) The Winners must arrive in Queensland between 1 and 2 October 2016 and depart Australia at latest by 25 February 2017, or such later applicable course completion date as specified in Schedule A.
(c) The Winners and Ultimate Winners must meet Australian visa requirements. The Winners and Ultimate Winners will need to determine their own eligibility to meet the Australian visa requirements.
(d) The Winners and Ultimate Winners must meet course entry requirements and must determine their own eligibility to meet each course entry requirements at each of the institutions listed in Schedule A. Winners and Ultimate Winners should visit Trade & Investment Queensland’s local education agent in your Participating Country to learn about course entry requirements.
(e) The prizes exclude student visa costs, travel insurance, overseas student health cover, public liability insurance, cover for dental and allied health expenses, excess baggage, meals, taxes, ancillary costs, tours, ground transportation, airport transfers in home country, room service, spending money, costs for text books or other study materials or any other costs of a personal nature not stated in Schedule A.
(f) For the avoidance of doubt, the prize for the Ultimate Winners does not include accommodation or costs for accommodation.
(g) Travel and holiday experiences associated with the prizes are subject to availability and reasonable costs at the time of booking.
(h) The State will arrange all flight bookings. Any changes or costs incurred once the tickets have been issued, including missed flights or missed connections, will be the sole responsibility of the Winners and the Ultimate Winners.
(i) Airline tickets have no cash value; unused portions cannot be redeemed for cash value. No Frequent Flyer points are awarded on these tickets.
(j) If a Winner or an Ultimate Winner misses a flight or connection, the Winner or Ultimate Winner must, at its own expense, arrange for a new ticket to their intended destination.
(k) The State is not responsible for any change in the value of any prize occurring between the publishing date and date the prize is claimed.
(l) Prizes are not transferable or exchangeable, and cannot be taken as cash.
(m) The State does not make any representations about the quality or functionality of any prize, nor is it endorsing the prizes or any party associated with the prizes.
(n) All courses undertaken by the Ultimate Winners must commence by 1 March 2017 unless otherwise stated. The Ultimate Winners acknowledge and agree that in the event of a conflict between the end date of a course in Schedule A undertaken as a Winner (“Winner Course”) and the start date of a Partial Scholarship, the Ultimate Winner may need to finish the Winner Course early so that the Ultimate Winner can start their Partial Scholarship on the designated commencement date for that Partial Scholarship.
(0) There are a total of twenty tuition prizes available and five Partial Scholarships available, as set out in Schedule A. There will be one Winner per tuition prize and one Ultimate Winner per Partial Scholarship. Entrants must select one tuition prize option and one Partial Scholarship prize option when submitting an Entry.

4. Eligibility

4.1. Entry to the Competition is open to persons aged eighteen years old and over as at 29 April 2016.

4.2. Each Entrant must be a citizen and permanent resident of a Participating Country.

4.3 Australian nationals or permanent residents and international students who are either presently or have previously studied in Australia on a student visa or working holiday visa are excluded from participation in the Competition.

4.4 Each Entrant must possess a current passport, be able to meet the legislative requirements of an applicable visa to Australia and be available to visit Australia during the period from October 2016 until February 2017 (or such later applicable course completion date as specified in Schedule A) if chosen as a Winner. Ultimate Winners must be available until February 2020. Each Entrant will need to determine their own eligibility to meet the Australian visa requirements.

4.5 An Entrant must not have been convicted of any criminal offence in any country and must not have had a visa rejected or have been deported from Australia or any other country.

4.6 Each Entrant authorises the State to conduct any civil, criminal, financial and other background or reference checks considered necessary or desirable by the State.

4.7 Directors, management, employees and contractors of Trade and Investment Queensland and those of any agencies and suppliers associated with the Competition are ineligible to enter.

4.8 Each Entrant is responsible for complying with applicable laws and regulations in its Participating Country, including but not limited to, obtaining consents from parents/guardians to participate in the Competition.

5. How to enter

5.1 To enter and be eligible to be a Winner or Ultimate Winner in the Competition, Each Entrant must, before the Closing Date:
(a) Create a profile (www.bestsemesterabroad.com.au);
(b) Complete “The Best Semester Abroad” official application form stating his/her full name as set out in his/her passport; and
(c) Create a one minute video and provide a YouTube link to their entry (“Video”) on why Queensland is the next step in their life, (“Entry”).

5.2 By submitting an Entry each Entrant agrees to comply with these terms and conditions.

5.3 As part of an Entry, a valid Video must:
(a) be in English;
(b) not be longer than 60 seconds;
(c) be received by the Closing Date. Any Entry received after that date for any reason including that the entry was lost, delayed, misdirected or is unable to be viewed for any reason may not be accepted in the absolute discretion of the State. No responsibility is accepted for late, lost, delayed or misdirected Entries or for Entries that are unable to be viewed for any reason;
(d) not contain any overt company or product branding (including URLs or telephone numbers) even with permission of that organisation;
(e) not be unlawful or fraudulent, or such that the State may deem (at its sole discretion) in breach of any intellectual property, privacy, publicity or other rights;
(f) not be defamatory, misrepresents or contains disparaging remarks about other people or companies,
(g) not contain any personal identification such as license plate numbers, email addresses or street addresses;
(h) not be obscene, pornographic, profane, insulting, sexually inappropriate, violent, abusive, harassing, threatening, extortionate, contrary to moral decency, objectionable or derogatory of any ethnic, racial, gender, religious, professional or age group;
(i) not include nudity, profanity or obscenity, or be otherwise unsuitable for publication;
(j) not promote illegal drugs, tobacco, firearms/weapons or any activity that may appear unsafe or dangerous or promotes any particular political agenda or message; hunting or gambling, cruelty to animals or humans or the irresponsible use of alcohol;
(k) be able to be viewed without technical issues;
(l) have 100 votes recorded by 26 June 2016. A winning Entry will not necessarily be the Video with the most number of votes. An Entrant may attract votes for their Video by inviting friends to vote for their Video; and

5.4 The application form must contain the Entrant’s contact details which must remain correct and kept up to date through the competition website. If not, the State may award the prize to another Entrant.

5.5 Each individual may only submit one Entry and additional Entries at the State’s sole discretion are subject to rejection and/or disqualification of the Entrant.

6. Judging

6.1 For the purposes of selecting a short list of Entries and for selecting Winners and Ultimate Winners, Entrants’ videos, profiles and application forms will be judged by the State’s nominated representatives (“Judges”), based on the Entrants who, in the Judges’ sole discretion, demonstrate will most benefit from a semester in Queensland, have the best reason to study in Queensland and are the most interesting, hardworking, motivated and inspiring.

6.2 The Judges’ decision on a shortlist of Entries (“Shortlist”) will be made and announced on Sunday 10 July 2016. The Judges’ decision on the Shortlist is in the Judges’ sole discretion and is final. The Shortlist will be made publicly available on the Competition website page (www.bestsemesterabroad.com.au). The number of Entries in the Shortlist is at the discretion of the State. Shortlisted Entrants will have 72 hours to confirm their continued participation once notified via email by the State. An email will be deemed to be received by an Entrant immediately after the email was sent (“Deemed Receipt”). It is the responsibility of each Entrant to ensure that they check their emails regularly and advise the State of any changes to their email address. If an Entrant on the Shortlist does not respond within 72 hours of Deemed Receipt then the State reserves its rights to offer the place to another Entrant or to not offer a place to another Entrant at all.

6.3 Short listed Entrants will be asked to submit a resume with referees and notarized copies of their qualifications including English level and academic records. The resume must include educational background, work experience and other skills. At least 3 referees must be provided including one academic, one employment and one personal. If Entrants do not meet the entry requirements of any of the prizes, the State may award the Prize to another Entrant.

6.4 The Shortlisted Entrants will be contacted for an interview. Interviews will be conducted in English only between 18 and 22 July 2016 via Skype or other web conferencing or video interviewing software. It is the responsibility of each Entrant to ensure they are available during these periods and has appropriate facilities (e.g. computer, Skype program installed, camera, appropriate internet connection) in order to attend the interview. In the interview, candidates will need to demonstrate that they will most benefit from a semester in Queensland, have the best reason to study in Queensland and are the most interesting, hardworking, motivated and inspiring.

6.5 The Winners will be announced on 29 July 2016. The Ultimate Winners will be announced on 1 February 2017. The Judges’ decision on the Winners and Ultimate Winners of the Competition is in the Judges’ sole discretion and is final. No further correspondence will be entered into. The number of Winners and Ultimate Winners of the Competition, and the Participating Countries that the Winners and Ultimate Winners come from is at the discretion of the State.

6.6 The State may notify Entrants if their Entry is invalid or rejected because it does not comply with these Terms, but it is under no obligation to do so.

6.7 The Winners and Ultimate Winners will be notified by email within three (3) business days of the Prizes being announced. The names of the Winners and Ultimate Winners will be published on the Study Queensland website (www.studyqueensland.qld.edu.au) and the Competition website (www.bestsemesterabroad.com.au). An email will be deemed to be received by Winners and Ultimate Winners immediately after the email was sent (“Deemed Receipt”). It is the responsibility of each Winner and Ultimate Winner to ensure that they check their emails regularly and advise the State of any changes to their email address. If a Winner or an Ultimate Winner does not respond within 72 hours of Deemed Receipt then the State reserves its rights to offer the prize to another Entrant or to not offer a prize to another Entrant at all.

7. Obligations of Winners and Ultimate Winners

7.1 The Winners and Ultimate Winners must apply for, pay and be granted a student visa to study in Australia.

7.2 The Winners and Ultimate Winners must apply for, pay and be granted Overseas Student Health Cover.

7.3 The Winners and Ultimate Winners must provide evidence of financial support for their visa application in the amount set out below:

The required evidence may be a copy of bank statements or any other evidence as required by the Department of Immigration and Border Protection.

7.4 The Winners and Ultimate Winners are expected to attend any courses required in accordance with these terms and conditions and are responsible for all costs and expenses associated with the courses, other than as set out in Schedule A. The Ultimate Winners may defer commencement of a course for a maximum one year period in order to meet course entry requirements. Each Winner and Ultimate Winner must use all endeavors to meet any relevant entry requirements at its own expense.

7.5 The Winners and Ultimate Winners must be of good moral character and:
(a) not be under the influence of any medication, drugs or other substances which may impair their ability to undertake the study and related activities;
(b) comply with these Terms and Conditions; and
(c) not publish any material which is disparaging of the State or of any sponsor of this Competition.

7.6 Any inappropriate, illegal or other behaviour which in the State’s opinion is immoral or illegal or tarnishes the reputation of any of the State or the key stakeholders of the Competition or in breach of these Terms and Conditions on the part of a Winner and/or an Ultimate Winner may result in the cancellation of the prize, either before or during the Competition period. The Winners and Ultimate Winners acknowledge and agree that the cancellation of any prize may result in the Winners and Ultimate Winners visa being cancelled and the Winners and Ultimate Winners being required to return to their home country. The Winners and Ultimate Winners acknowledge and agree that if any part of the prize is cancelled, the State is not responsible for any associated costs and is not liable to pay to the Winners or Ultimate Winners any value of the prizes not used.

7.7 The Winners must sign a Volunteer Agreement with the State.

7.8 The Winners must provide an accommodation bond for the amount against the relevant location as set out below:

The accommodation bond will be refunded by the accommodation provider if the Winners comply with his/her accommodation obligations. The Winners acknowledges and agrees that the State will not be held responsible or liable for the return of any accommodation bond.

7.9 The Winners and Ultimate Winners must provide any documentation and complete any forms as required by the Prize sponsors.

7.10 The Winners and Ultimate Winners are expected to Blog on his/her experiences in Queensland through relevant social media, websites and other channels or as advised by the State. The Winners and Ultimate Winners are expected to make themselves available to be photographed or filmed from time to time (at the State’s sole discretion) or as advised by the State and/or to submit regular video diaries. The Winners and Ultimate Winners are expected to attend promotional events as invited by the State in the voluntary role as Queensland’s international student ambassador. The Winners and Ultimate Winners acknowledge that the Blogs may be edited by the State at its sole discretion and the Blogs must not contain any content that:
(a) is unlawful or fraudulent or in breach of any intellectual property, privacy or other right or is defamatory and represents or contains disparaging remarks about other people or companies or contains any personal identification for anyone who has not given written authority for disclosure on the Blogs;
(b) is obscene, pornographic, profane, insulting, sexually inappropriate, violent, abusive, harassing, threatening, extortionate, contrary to moral decency, objectionable or derogatory of any ethnic, racial, gender, religious, professional or age group or includes nudity, profanity or obscenity or is otherwise unsuitable for publication;
(c) promotes illegal drugs, tobacco, firearms, gambling or weapons or the use of any of these or promotes any activity which may appear unsafe or dangerous;
(d) promotes the irresponsible use of alcohol;
(e) promotes any particular political agenda or message; or
(f) contains any company or product branding other than as authorised by the State,
and the Winners and Ultimate Winners must remove any content which breaches these conditions immediately upon request from the State.

7.11 Blogging may be in English or his/her native language and may include reports, diaries, video diaries, blogs, photos, social media posts and other online communications (“Blogs”). The posts should concern a range of topics that reflect a balanced view of the Winners’ academic, social and work experience in Australia. Each communication should be at least 50 words and include photos or videos of the experiences.

8. Entrants consents and warranties

8.1 By submitting the Entry, each Entrant warrants to the State that the Entrant is the sole owner of all intellectual property rights (including copyright) in any photo, video, Blog, voice, image and any information contained in the Entry or subsequently provided by the Entrant (in any medium) including the Entrant’s name, signature and other personal or identifying details or information (“Entrant Information”) and each Entrant grants the State a royalty-free, world-wide, non-exclusive, transferrable, irrevocable, perpetual licence (including the right to sub-licence) to use, exploit and otherwise exercise all such intellectual property rights (including to reproduce and publish) for any purpose connected with the Competition or similar competitions and promotions or for such other future promotional activities as the State deems fit. Each Entrant consents to any act that might otherwise constitute an infringement of the Entrant’s ‘moral rights’ under the Copyright Act 1968 (Cth).

8.2 Each Entrant consents to the State using the Entrant’s image, photo, video, name, signature, voice, image and any other Entrant Information for any purpose connected with the Competition or similar competitions and promotions or for such other future promotional materials as the State deems fit.

8.3 The Winners and Ultimate Winners consent to being filmed and photographed as set out in these terms and conditions.

8.4 Each Entrant acknowledges and agrees that the State may in its sole discretion provide any material or information (including Entrant Information) created or concerning the Entrant to the State’s appointed public relations company, the sponsors of the Competition or other agencies for its use in the above mentioned promotional purposes. Each Entrant accepts that media or the sponsors of the Competition may contact the Entrant to discuss the Entry and each Entrant agrees to participate fully with the media or the sponsors of the Competition as requested by the State. Each Entrant acknowledges and agrees that the State and/or its appointed public relations company and/or the sponsors of the Competition may use, or not use, any photo, video or any information (including Entrant Information) in the Entry, and in the case of the Winners and Ultimate Winners, any information, images and/or videos contained in a blog, at its sole discretion.

8.5 Each Entrant, and where applicable the Winners and Ultimate Winners, acknowledge and agree that:
(a) their personal information (including Entrant Information) will be collected by the State for the purpose of coordinating/ administering the Competition and for notifying Entrants of upcoming events, initiatives and programs administered by the State in accordance with its Privacy Policy.
(b) if the Entrant wins a prize, the Entrant consents to the State publishing their name and other personal details (including Entrant Information) in connection with the Competition in current or future promotional materials and using this information as authorised under these terms and conditions.
(c) by submitting any photo, video and blog, each Entrant warrants that all recognisable persons in the video consent to the State or its agents publishing their images for use in the Competition and for current or future promotional purposes.
(d) each Entrant warrants that any photo, video and Blog is original, has not been submitted for any other competition and is not based on the work of any other person.

8.6 Each Entrant acknowledges and agrees that Winners are responsible for arranging and paying for any accommodation beyond the 20 weeks accommodation provided as a prize, including where any tuition provided as a prize runs beyond 25 February 2017.

8.7 Each Entrant warrants and represents that it has disclosed to the State any physical or mental impediment that they believe may prevent them from performing any activities required or expected of the Entrant as part of these terms and conditions, the competition, any prize or any ancillary activities.

9. General

9.1 Compliance with any lawful requirements is the responsibility of the Winners and Ultimate Winners. Travel is subject to the General Conditions of Carriage of the applicable airline.

9.2 The Winners and Ultimate Winners acknowledge and agree that the State is not responsible for any refusal or cancellation of a visa and that if the Winners or Ultimate Winners breach a term of their visa and are required to return to their home country that the State is not responsible for any associated costs and is not liable to pay to the Winners or Ultimate Winners any value of the prizes not used.

9.3 If this Competition is compromised in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the State, the State reserves the right in its sole discretion to modify, suspend, terminate or cancel the Competition.

9.4 To the full extent permitted by law, the State is not liable for (and each Entrant hereby releases and holds the State harmless in respect of) any injury, damages, expenses, costs, liabilities or loss whatsoever (including but not limited to indirect or consequential loss) to persons or property by reason of any act or omission, deliberate or negligent, by the State, or its officers and agents in connection with participation in the Competition or the arrangements for supply, or the supply, of any prizes to the Winners and Ultimate Winners of the Competition.

9.5 The State reserves the right to amend the Terms and Conditions at any time until the Closing Date. Any amendments will be notified on the competition website.

9.6 To the full extent permitted by law, no person is entitled to claim compensation or loss from the State for any matter arising out of the Competition, including but not limited to a failure by the State to comply with the Terms and Conditions.

9.7 The State’s decision in relation to any aspect of the Competition is final and binding on every person who enters.

9.8 The State reserves the right to accept or reject any Entry at its sole discretion.

9.9 The Terms and Conditions are governed by the laws of Queensland.

9.10 These Terms and Conditions have been prepared in English and any translation into the language of a Participating Country is prepared for reference only. In the event of any inconsistency, the English language version shall apply and be binding on the parties.

9.11 Each Entrant acknowledges and agrees that all media interviews in relation to the Competition or volunteer arrangements require the prior approval of the State and the State reserves the right to edit any media interviews at its sole discretion.

9.12 Each Entrant acknowledges and agrees that in these Terms and Conditions:
(a) words in the singular include the plural and vice versa; and
(b) if a word or phrase is defined its other grammatical forms have corresponding meanings.

Schedule A

Winners Prizes
Return economy airfare to Brisbane, Cairns or Gold Coast International Airport from an International Airport in the Participating Country up to the value of AUD$5,000 depending on the origin and destinations of the Winners.
Transfers from Brisbane, Cairns or Gold Coast International Airport within Queensland up to the value of AUD$400 return

1. Australian Catholic University (Brisbane campus) – English Language Intensive Courses for Overseas Students (“ELICOS”) from 10 October 2016 to 24 February 2017 including 2 week term break to the value of AUD$7,200
2. Aviation Australia + Viva College – 7 weeks of Certificate II Aviation Operations course from 10 October to 25 November 2016 followed by 13 weeks ELICOS from 28 November to 24 February including 1 week term break to the value of AUD$11,400. Minimum English level and academic requirement for Certificate II is IELTS 5 or equivalent and Year 10 equivalent.
3. BROWNS Professional Certificate IV in Business or Diploma in Business from 17 October 2016 to 17 March 2017 including 1 week term break to the value of AUD$14,800. Minimum English level and academic requirement is IELTS 5.5 or equivalent and Year 11 equivalent. As accommodation is only provided until 25 February, the winner of this prize will need to cover the extra accommodation needed until 17 March 2017 to complete the course.
4. Careers Australia English for Academic Purposes and Certificate III in Aged Care from 10 October 2016 to 24 February 2017 including 1 week term break to the value of AUD$6,000. Minimum English level and academic requirement is IELTS 5.5 and Year 12 equivalent.
5. CHARLTON BROWN Certificate III in Early Childhood Education and Care from 10 October 2016 to 24 March 2017 including 2 weeks term break to the value of AUD$4,600. Minimum English level and academic requirement is IELTS 5 and Year 12 equivalent. As accommodation is only provided until 25 February, the winner of this prize will need to cover the extra accommodation needed until 24 March 2017 to complete the course.
6. Langports ELICOS from 10 October 2016 to 24 February 2017 including 1 week term break to the value of AUD$7,840.
7. Queensland International Institute Certificate II or III in Spoken and Written English from 10 October 2016 to 24 February 2017 including 2 weeks term break to the value of AUD$5,000.
8. Sarina Russo – Unipath or English for Academic Purposes from 10 October 2016 to 24 February 2017 including 2 weeks term break to the value of AUD$5,300
9. The University of Queensland, Institute of Continuing & TESOL Education (ICTE) ELICOS from 10 October 2016 to 17 March 2017 including 3 weeks term break to the value of AUD $8,320.
